Service Agreement

Information on fees and service delivery options are available on request. For NDIS participants, fees reflect the latest Price Guide as they are released. For Private clients, fees are subject to annual review in June to take effect from July 1 each year.
Clients will be informed of the fee increase through the company newsletter.
Therapeutic Supports:
We are constantly looking for new talent and ways of diversifying our supports for families. A comprehensive and up-to-date list of supports can be found on our website. Additionally, we offer therapy assistant appointments to support clinical intervention. We agree to provide you with the supports you have requested and adjust this to meet your families' developing needs.
● Review our website for a comprehensive list of current groups, programs, and services.
● Supports are delivered in an individual manner, and plans are made in conjunction with the participant and/or the participants representative.
● Our variety of services and supports are subject to change. We will notify you in writing of any deviation to your agreed supports.
Costs:
Your appointment fee is inclusive of:
● Basic treatment planning
● Intervention completed/service provision
● Treatment notes and other administration
● All our clinical services incur a fee. This fee is individual to the type of therapeutic support being provided
● For NDIS participants, this will reflect the most up to date NDIS price guide
Additional fees may apply for more complex planning, however this will be discussed before completed and invoiced.
Support Structure:
We operate our sessions to a 45-5-10 policy. This means, 45 minutes of intervention, 5 minutes of parent discussion and setting up home programs, and 10 minutes of administration. This may include setting up resources for your next session, emailing information, treatment notes and any other responsibilities.
Some of the supports we provide include, but is not limited to:

● Reports and Home Programs
● Groups and Programs
● Parent Consults and Training Sessions
Services are offered on a first come first serve basis. Existing clients will be prioritised over new clients, except if supporting the existing client is causing disruption to the company.

The Provider has a therapy assistant program, that is used to provide therapeutic supports to a significant number of our Participants. The therapy assistants at Spring Forward go through extensive training to implement the session plans provided to them.
Therapy Assistants CAN:
● Run therapy sessions
● Complete the activities provided to them
● Provide Feedback to the clinical team
● Handover home programs written by clinical team members
Therapy Assistants CANNOT:
● Develop home programs
● Answer complicated questions
● Provide solutions to complex challenges
● Run parent consults where education is provided
Conditions of the Therapy Assistant Program:
● A comprehensive plan must be paid for and completed before a participant can see a therapy assistant
● A review appointment and comprehensive plan must be completed and paid for once every 3 months
● Only the provider has the right to waive a therapy assistant review program, but this is in rare circumstances
● The clinical team will determine a clients suitability to see a therapy assistant based on set criteria, including but not limited to:
◦ Complexity to intervention plan
◦ Behaviour supports
● Therapy assistant appointments may need to be adjusted with minimal notice if behaviour patterns change and require a therapist level of support.

The Provider respects the existence of cancellation policies provided by funding providers such as the NDIS. Our internal re-purposing policy has been developed to ensure a diverse and consistent provision of services to our clients. It is the same policy for all clients funded in all manners and in alignment with all providers.
A re-purposed appointment is when a previously booked face-to-face appointment is changed on short notice to another form of support. This may be, but is not limited to:
● A zoom appointment
● A parent consult
● A report
● Home program report
● Sensory diet
● School strategies report
● Visual Schedule
● Other resources development for use at home/school

● I understand that, by signing this Service Agreement, I am legally agreeing to all the following statements in exchange for being permitted to use the provider’s equipment and services for myself, my child(ren) and those in my care.
● I fully understand that physical activities involve risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my actions, or inactions, of others participating in activities, the conditions in which the activities take place, or the negligence of the "releases" named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs and damages I incur as a result of my participation in services.
● I acknowledge that if I believe activity conditions are unsafe, I, my child(ren) and those in my care will immediately discontinue participating in the activity.
● I acknowledge responsibility for the actions of myself, my child(ren) and those in my care whilst participating.
● I understand and agree that while the Provider has taken precautions to minimise risk and provide a safe environment, there are always unpredictable risks associated with any physical activity.
● I collectively acknowledge for myself, my child(ren) and those in my care that we voluntarily participate or partake of services for our benefit and I assume responsibility for any injury or serious bodily harm, including permanent disability, death or serious loss, which may arise or we may sustain while participating in services provided by the Provider.
● I indemnify, release and hold harmless the Provider (including owners, employees, assistants, shareholders, and partners) against all claims, actions, suits, demands and expenses, including all legal and medical expenses in any way arising out of the use of the Provider equipment and services.
● This waiver shall cover all liability along with associated costs and apply to all risk, known and unknown, even if resulting from negligent actions of other participants or employees of the company.
● I acknowledge and accept that there is a risk of loss, theft, damage and destruction to my personal property. I agree that I am solely responsible for my property, including but not limited to personal possessions and equipment.
● I understand that the Provider reserve the right to alter services, close or withdraw equipment and services, to postpone, reschedule or cancel services if conditions warrant it or otherwise at the Provider’s discretion, and that any fees collected will be non-refundable.
I have read this WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY AND RELEASE AGREEMENT, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement and assurance of any nature and intend it be a complete and unconditional release of all liability to the greatest extent allowed by law.

The provider will only use information subscribers have provided to create, send and manage emails, per the preferences chosen by subscribers. We will also use this information to measure email performance and to improve the features for specific segments of customers, evaluate your use of our website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage.
As MailChimp is based in the United States of America (USA) and the information generated by cookies about your use of the website (including your IP address) will be transmitted to and stored by MailChimp on servers located outside Australia, we are required to inform you that by subscribing to our eNewsletter:
● You consent to your personal information being collected, used, disclosed and stored as set out in Mail Chimp’s Privacy Policy and agree to abide by Mail Chimp’s Terms of Use; you understand and acknowledge that this service utilises a MailChimp platform, which is located in the USA and relevant legislation of the USA will apply.
● You understand and acknowledge that you will not be able to seek redress under the Australian Privacy Act 1988 (Cth) but will need to seek redress under the laws of the USA.
Principle 8.1 requires us to take steps as are reasonable in the circumstances to ensure that MailChimp does not breach the Australian Privacy Principles concerning the information given by the subscriber. This would no longer apply if you signed up to a subscription service of the Provider in which MailChimp is used.
You can opt-out of our mailing list if you choose the 'unsubscribe' service provided by MailChimp in every email or contact the Provider. You can also disable or refuse cookies or disable Flash player; however, you may not be able to use the services provided by MailChimp if cookies are disabled. Should you wish to contact MailChimp, you can find contact details on the Contact MailChimp page.
MailChimp has the endorsement of TRUSTe’s Privacy Seal, which means this privacy policy has been reviewed by TRUSTe for compliance with their program requirements including transparency, accountability, and choice related to the collection and use of your personal information. TRUSTe is an independent third party that operates a globally-recognised privacy Trustmark.

The provider acknowledges that on occasion, it is helpful for parents and caregivers to record therapy for home program purposes.
By signing this form, the caregiver agrees to the following:
● That no images or footage will be recorded until this form has been signed
● Discussion and consent must occur between the Therapist and parent/caregiver before each incident of footage being taken
● The footage is not to be taken exclusively of the Centre interior or exterior
● The footage is not to be taken of any other client present at the Centre
● Footage must not be used for any purpose other than private home use for practicing therapy
● Footage must not be uploaded to social media or any public media forum (e.g., YouTube, Facebook, etc.) without written permission from the provider
● Footage must not be sent to or shared with anyone other than those responsible for the child’s therapy
● If the footage is taken in a school visit setting, that no other children or teachers are recorded
● Therapist’s face, and where able, shirt logo is not to be in the video
The providers therapists agree to the above-mentioned conditions.
Where recording is deemed helpful or necessary during therapy for the Provider or it’s representatives, this footage will be stored securely and confidentially. It will only be used for internal clinical evaluation, learning or case study development (internally). This footage will not be used externally to the providers immediate and internal business practices.

By acknowledging permission below, you are permitting the provider to use photographs & videos of your child and copies of their work for advertising purposes and promotion of services at Spring Forward Family Centre. Publication of your child's image may be used on the official website, Facebook page, brochures, displays within the Centre and promotional material. The photographs & videos may be labelled with the child's first name only. No child's image with a client/participants face or identifying features will be published without providing the Caregiver the opportunity to opt out.
If you sign the form below you are consenting to the following:
● The provider can take photographs/videos of your child during assessment and/or therapy sessions. You will be informed of this on each occurrence
● The provider can publish photographs/videos and samples of your child's work as many times as it requires in the ways mentioned above
● The provider will not use your child’s photographs/videos or samples for any purpose other than in the above-mentioned ways
● Permission may be withdrawn at any time upon written notification

The Provider's services require personal information from families to provide appropriate and responsive care. This information needs to be maintained and managed by the Provider privately and confidentially.
The Provider will maintain private and confidential information for therapists, children and their families. These records will be securely stored and maintained.
The Provider will;
● Ensure that information collected from families, therapists and the community is maintained privately and confidentially at all times
● Maintain records according to the National Privacy Principles
The Provider will not;
● Use or disclose personal information about the Participant for a purpose (the secondary purpose) other than the primary purpose of collection unless both of the following apply;
● The secondary purpose is related to the primary purpose of collection and, if the personal information is sensitive, directly related to the primary purpose of the collection;
● The individual would reasonably expect the organisation to use or disclose the information for the secondary purpose; the individual has consented to the use or disclosure
The Participant adheres to The Privacy and Personal Information Protection Act 1998 and The Health Records and Information Privacy Act 2002. All of the Provider’s employees are bound by a signed confidentiality agreement. Client information may be used to inform the Participant of appointments or upcoming events. The Provider will attain parental/carer permission before discussing sensitive client information with teachers, doctors, and any third parties.

A SAFE AND RESPECTFUL ENVIRONMENT
The Provider is committed to providing a safe and respectful environment for all who engage in our services.
One of our priorities is to ensure that the premises are at all times a safe place for those that attend. The Provider upholds best practice in Work Health and Safety requirements and the standards of the NSW Office of the Children's Guardian for a child-safe environment.
We greatly value the partnership we hold with you as parents and/or carers of the children who attend our services.
For these reasons, we ask that you read the following and adhere to our service’s code, our service’s expectations and our service’s standards to ensure a safe and respectful environment.
SAFETY AND RESPECT STANDARDS;
● All children must be supervised at all times by their parent/carer in the Reception area or around the clinic. It is not acceptable to leave a child in the care of Reception staff; if a child is left in the care of Reception, a $10 fee will be incurred
● Treat everyone with respect and honesty. Offensive or threatening behaviour or language is not acceptable on the premises
● Parents/carers and staff aim to be positive role models for their children at all times
● Parents/carers must be present 15 minutes before the end of each session so they can discuss treatment with therapists

I have read and understood the Safety and Respect Standards of the Provider. I agree to support the service to uphold these standards
